OPINION AND ORDER by Judge John E Dowdell Defendants' Motion to Dismiss (Doc. 5) is granted in part and denied in part. Plaintiff's state law claims are dismissed for lack of subject matter jurisdiction. Plaintiff shall file within 2 1 days of the date of this Opinion and Order an amended complaint which cures the deficiency noted with respect to its § 1983 claims against Avalon and TRC.
