Filing 13 OPINION AND ORDER by Judge John E Dowdell The City of Bartlesville's Motion to Dismiss (Doc. 5) plaintiff's state law claim against the City is granted. The Motion to Dismiss of defendants Silver and McClintock (Doc. 6) is granted as to the section 1983 claims against them in their official capacities, but is denied in all other respects. Within 14 days, defendants shall file their answers to the claims surviving against each of them. The Court will enter an order for JSR and, a s a result, the City's Motion for Status and/or Scheduling Conference (Doc. 12) is moot ; granting 5 Motion to Dismiss for Failure to State a Claim; granting in part and denying in part 6 Motion to Dismiss for Failure to State a Claim; finding as moot 12 Motion for Hearing (Re: 2 Complaint ) (JED1, Chambers) |
