***Civil Case Terminated (see document number 3 ) (sc, Dpty Clk) |
Filing 3 MINUTE ORDER by Judge Terence Kern - Complaint names only the United States of America as a defendant and provides no jurisdictional basis for his suit against the Government. [Doc. 1] A party seeking to assert a claim against the Government must point to a specific waiver of sovereign immunity in order to establish jurisdiction. Pueblo of Jemez v. United States, 790 F.3d 1143, 1151 (10th Cir. 2015). Because Plaintiff has pointed to no such specific waiver in his Complaint, it must be dismissed for lack of jurisdiction. Accordingly, the case is dismissed without prejudice, and Plaintiff's Motion for Leave to Proceed in Forma Pauperis [Doc. 2] is denied as MOOT ; dismissing/terminating case (terminates case) ; denying #2 Motion for Leave to Proceed in Forma Pauperis (Re: #2 MOTION for Leave to Proceed in Forma Pauperis ) (This entry is the Official Order of the Court. No document is attached.) (lmc, Chambers) |
Filing 2 MOTION for Leave to Proceed in Forma Pauperis by Cole Walker Morris (blc, Dpty Clk) |
Filing 1 COMPLAINT against United State's of America by Cole Walker Morris (blc, Dpty Clk) Modified on 12/27/2022 to correct party name (blc, Dpty Clk). |
