MEMORANDUM OPINION - Because Defendant enjoys immunity under the Eleventh Amendment, the Court lacks subject-matter jurisdiction over Plaintiffs claims, which must be dismissed without prejudice. Brereton v. Bountiful City Corp., 434 F.3d 1213, 1218 (10th Cir. 2006). Accordingly, Defendants Motion to Dismiss Dkt 7 is herein GRANTED. Signed by Honorable Robin J. Cauthron on 2/08/2011. (cps)
