Filing 33 ORDER the Motions to Dismiss Amended Complaint filed by the BOCC and Whetsel [Doc. Nos. 21, 22] are GRANTED. Counts One and Two of the Amended Complaint against the BOCC and Whetsel are dismissed without prejudice. Finding no other independent basis for federal jurisdiction, Plaintiff's negligence claim (Count Three) against the BOCC and Whetsel is remanded to the District Court of Oklahoma County, Oklahoma. The Court also finds that Plaintiff need not be granted leave to further amend her pleading. Further, Plaintiff's claims against Armor, John Doe 1- 10, and CHM are dismissed without prejudice pursuant to FED. R. CIV. P. 4(m).granting 21 Motion to Dismiss; granting 22 Motion to Dismiss.
