ORDER granting in part and denying in part 14 Motion to Dismiss. Plaintiffs claims against Defendant Elizabeth Cipolletti are DISMISSED WITHOUT PREJUDICE due to the Courts lack of personal jurisdiction over her. Plai ntiffs claims against the John Doe Defendants are DISMISSED WITHOUT PREJUDICE. Plaintiffs negligent performance of contract claim is DISMISSED WITH PREJUDICE.
