ORDER granting 22 Motion for Summary Judgment. For the reasons set forth herein, Plaintiffs claims under section 502(a)(1) are hereby remanded for further consideration. Plaintiffs claim under § 502(a)(3) for br each of fiduciary duty is hereby held in abeyance pending the outcome of the remand proceedings. Defendant is granted summary judgment on Plaintiffs claim for interference under § 510. The Court will administratively close this action pending the termination of remand proceedings.
