ORDER ~ On December 1, 2021, Defendant filed a Notice of Constitutional Question #8 , advising that it filed an Answer to Plaintiffs' Petition that questions the constitutionality of Oklahoma's punitive damages statute. Because the statute affects the public interest, the Court finds that pursuant to Federal Rule of Civil Procedure 5.1(b) and 28 U.S.C. 2403(b), certification to the Attorney General of Oklahoma is necessary. The State of Oklahoma may intervene in this action by notifying the Court of its intent to do so not later than sixty (60) days from the date of this Order. Signed by Judge Bernard M.
