ORDER: I DENY defendants' motion to dismiss plaintiffs' DPPA claim under Rule 12(b)(1). I DENY as moot defendants' Rule 12(b)(6) motions to dismiss plaintiffs' claim under 18 U.S.C. § 2722. I GRANT defendants' Rule (b)(6) motions to dismiss plaintiffs' claim under 18 U.S.C. § 2724(a) and dismiss that claim with prejudice. I decline to exercise supplemental jurisdiction over plaintiffs' Invasion of Privacy claim and dismiss that claim without prejudice. IT IS SO ORDERED. Signed on 9/22/2010 by Judge Owen M. Panner.
