ORDER by Judge Acosta -- Plaintiff filed this lawsuit in this district's Portland Division. At page 2 of the complaint, paragraph 7, plaintiff alleges. "All of the acts about which Plaintiff complains occurred in Crater Lake, Oregon, which is located in the Oregon District of the United States District Court." Under USDC Oregon Local Rule 3-2(b), "For purposes of these Local Rules, 'divisional venue' means the division of the Court in which a substantial part of the events or omissions giving rise to the claim occurred, or a substantial part of the property that is the subject of the action is situated." Crater Lake is located in Klamath County, which county is assigned to the district's Medford Division for purposes of case management. See USDC Oregon Local Rule 3-2(a)(4). Because the acts upon which plaintiff's lawsuit is based all occurred in Klamath County, plaintiff's lawsuit should have been filed in this district's Medford Division. Accordingly, it is ORDERED that plaintiff's lawsuit be transferred to this district's Medford Division. (peg)
