Filing 59 ORDER - The Court ADOPTS Judge Jelderks's Findings and Recommendation 52 , with the exception of his recommendation that the Court decline to issue a Certificate of Appealability. The Court DENIES Petitioner's request for an eviden tiary hearing, DENIES relief on the Petition for Writ of Habeas Corpus, and this case is DISMISSED with prejudice. The Court, however, issues a Certificate of Appealability on the basis that Petitioner has made a sufficient showing of the denial of a constitutional right pursuant to 28 U.S.C. § 2253(c)(2).
