ORDER TO AMEND: Within thirty days from the date of this Order, Plaintiff shall file an amended complaint curing the deficiencies noted above. The Court notes that the amended complaint will operate as a complete substitute for the present complaint, not as a supplement. The Court cautions Plaintiff that if he does not file an amended complaint within thirty days, this action will be dismissed. The Court DENIES Motion for Appointment of Counsel (#3 ) because he has failed to demonstrate that exceptional circumstances warrant appointing counsel in this case.
