The court construes this as a notice of dismissal without prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i) and directs the Clerk of the Court to close this case.In light of the voluntary dismissal, the Court hereby withdraws the December 23, 2025, Order to Proceed In Forma Pauperis and to Collect Inmate Filing Fee (ECF #5 ) and relieves plaintiff of the obligation to pay any further filing fees related to this case. ORDER TO PROCEED IN FORMA PAUPERIS AND TO COLLECT INMATE FILING FEE: Plaintiff's application to proceed in forma pauperis (ECF No. #4 ) is GRANTED. IT IS ORDERED that the Oregon Department of Corrections, Central Trust Unit or his designee shall collect from Plaintiff's trust account an initial partial filing fee in the amount of $37.00 and shall forward the amount to the Clerk of the Court. Said payment shall be clearly identified by the name and number assigned to this action. IT IS FURTHER ORDERED that thereafter, the Oregon Department of Corrections, Central Trust Unit shall collect from Plaintiff's prison trust account the $313.00 balance of the filing fee and shall forward payments to the Clerk of the Court in accordance with the formula set forth above. The payments shall be clearly identified by the name and number assigned to this action. A copy of this order has been emailed to the Central Trust Unit.
