ORDER TO DISMISS. The Court DISMISSES Richey's Complaint (ECF No. #2 ) for failure to state a claim upon which relief may be granted. Because it is clear Richey cannot cure the complaint's deficiencies by amendment, the Court DENIES leave to amend and DISMISSES this action with prejudice.
