OPINION AND ORDER: For these reasons, the Court GRANTS in part and DENIES in part Defendants' Motion (#37) for Partial Summary Judgment asfollows: 1. The Court GRANTS Defendants' Motion for Partial Summary Judgment as to Plaintiff&# 039;s First Claim against Sgt. Gorton for excessive force; 2. The Court GRANTS Defendants' Motion for Partial Summary Judgment as to that portion of Plaintiff's Second Claim for battery related to acts of Sgt. Gorton;3. The Court DENIES Def endants' Motion for Partial Summary Judgment as to that portion of Plaintiff's Second Claim for assault related to acts of Sgt. Gorton;4. The Court DENIES Defendants' Motion for Partial Summary Judgment as to Plaintiff's Third Cla im against Deputy Hathaway for malicious prosecution under § 1983; and 5. The Court GRANTS Defendants' Motion for Partial SummaryJudgment as to Plaintiff's Third Claim against Multnomah County for malicious prosecution under state law.
