Order. The Court ADOPTS Magistrate Judge Stewart's Findings and Recommendation to remand. The Court DECLINES to adopt the Magistrate Judge's recommendation to deny Plaintiff's request for attorneys' fees and costs incurred as a result of Defendants' removal of this action to this Court. If the parties do not stipulate to attorneys' fees and costs by 12/30/2010, Plaintiff shall file no later than 1/7/2011, a motion for attorneys' fees and costs.
