Filing 59 Opinion and Order - Farriss motion to dismiss 32 is GRANTED in part and DENIED in part. Because Vineyard failed to effect proper service of process on Farris, service is quashed. Vineyard is ordered by January 17, 2012, either to perfect s ervice on Farris or to file Farriss acceptance of service. Farriss motion under Rule 12(b)(6) to dismiss the § 1983 claims and the common law tort claims is DENIED. Farriss special motion to strike under Or. Rev. Stat. § 31.150(2)(c) is also DENIED.
