Filing 29 OPINION AND ORDER - The Opinion was not completely irrational, the Arbitrator did not manifestly disregard the law, and the payment of severance benefits to Dooley will not violate public policy. Accordingly, this court does not have grounds to vacate the Arbitrator's award. ESI's Second Amended Motion 13 to Vacate the Arbitration Award is DENIED. Dated this 17th day of May, 2011, by U.S. Magistrate Judge John V. Acosta. (peg) |
