July 9, 2012	Filing 39 OPINION and ORDER - The Association's motion to dismiss 30 is GRANTED with regard to the federal trademark dilution claim based on tarnishment asserted in the Third Claim for Relief without prejudice and the claim for violation of the Act found in the Sixth Claim for Relief with prejudice. The Association's motion to dismiss 30 is DENIED in all other respects. The Association shall file an answer to the Complaint within twenty days of the entry of this Opinion. The Mill is granted le ave to file an amended complaint alleging specific facts supporting the dilution by tarnishment claim, as well as any other amendments to the Complaint, no later than forty-five (45) days before the close of discovery.
