OPINION AND ORDER: I hereby GRANT Defendant Tyson Hodgess motion to dismiss 61 for failure to state a claim. I also GRANT Defendant United States motion to dismiss 62 for lack of subject matter jurisdiction under the FTCA and for failure to state a claim.
