ORDER: I ADOPT the Report and Recommendation of Magistrate Judge Clarke 130 , as modified above. Defendants' motion for summary judgment 62 is GRANTED and this case is DISMISSED with prejudice. Plaintiff's pending motions to compel discovery and take depositions 52 and 55 and to file an amended complaint 47 and 56 are DENIED. Plaintiff's request for oral argument is denied as unnecessary.
