Filing 44 OPINION & ORDER: The Individuals Defendants' motion to dismiss 34 is GRANTED. Individual defendants Dr. Matthews, Dr. Turner, Ms. Utterberg, Ms. Anger, Mr. Tell, and Officer Spinas are hereby dismissed. The Government's motion to d ismiss 29 is GRANTED, and McKinley's second, third, and fifth claims for relief are hereby dismissed. McKinley's motion for leave to file a second amended complaint 33 is DENIED because it is futile. McKinleys medical malpractice claim against the United States for the conduct of the various VA medical providers remains. See 22-page opinion & order attached. Ordered by Judge Marco A. Hernandez.
