Opinion and Order - Intel's Motion for Partial Judgment on the Pleadings (Dkt. 108) is GRANTED. Memory Integrity has had more than a year to conduct discovery directed at uncovering factual support for its claims. Memory Integrity has also amend ed its complaint twice without curing the deficiencies in its induced infringement claims. Accordingly, the Court finds that leave to amend would be futile. See DeSoto v. Yellow Freight Sys., Inc., 957 F.2d 655, 658 (9th Cir. 1992) (A district court does not err in denying leave to amend where the amendment would be futile.).
