OPINION AND ORDER: The Petition for Writ of Habeas Corpus 1 is dismissed, with prejudice, for lack of jurisdiction. The court does, however, grants a certificate of appealability on the issues of: (1) whether petitioner has made a showing of actual innocence so as to establish habeas corpus jurisdiction; and (2) if so, whether the imposition of petitioner's ACCA sentence violates his constitutional rights.
