FINDINGS OF FACT & CONCLUSIONS OF LAW: Based on the Administrative Record, the Court construes the motions for summary judgment ( 41 , 42 ) as Trial Memoranda in connection with a bench trial. For the reasons explained herein, the twenty-fo ur month limitation on disability benefits in the LTD Policy does not apply. As a result, I find in favor of Plaintiff. Plaintiff shall prepare an appropriate Judgment consistent with these Findings & Conclusions, and after conferring with Defendant, shall submit it to the Court for signature within 14 days of the date below.
