The motion is denied as t o the quantum meruit and fraud claims. Plaintiff's motion for partial summary judgment 76 is granted as to the waiver affirmative defense. The motion is denied as to the express contract and estoppel affirmative defenses and is denied as moot as to the unclean hands affirmative defense.
