February 5, 2019 Opinion or Order Filing 26 ORDER - Plaintiff's counsel's motion for attorney fees pursuant to 42 U.S.C. § 406(b) (ECF 25 ) is GRANTED. Plaintiff's counsel is entitled to $25,430.75 in § 406(b) fees, representing 25 percent of Plaintiff� 39;s retroactive benefits recovery. When issuing the section 406(b) check for payment to Plaintiff's attorney, the Commissioner is directed to subtract the $6,146.49 previously awarded under EAJA and send Plaintiff's attorney the balance of $19,284.23, less any applicable administrative assessment as allowed by statute. July 17, 2017 Opinion or Order Filing 23 ORDER FOR EAJA FEES: Based upon the Stipulation of the parties, the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412, and Plaintiffs EAJA petition, it is hereby ordered that EAJA attorneys fees of $6146.49 shall be awarded to Plaintiff, unless there is an allowable offset under the Department of the Treasurys Offset Program. See Astrue v. Ratliff, 130 S.Ct. 2521 (2010). There are costs, in the form of a filing fee in the amount of $400, compensable under 28 U.S.C.A. § 2412 (2). There are no expenses.
