December 20, 2016 Opinion or Order Filing 9 ORDER - No party having made objections, this Court follows the recommendation of the Advisory Committee and reviews Judge Jelderk's Findings and Recommendation for clear error on the face of the record. No such error is apparent. Accordi ngly, the Court ADOPTS Judge Jelderk's Findings and Recommendation, ECF 6 . Plaintiff's complaint is dismissed without prejudice. Plaintiff has until January 20, 2017, to file an amended complaint if Plaintiff can cure the deficiencies ide ntified in the Findings and Recommendation. The Court further finds that any appeal from this Order would not be taken in good faith and Plaintiff's in forma pauperis status should be revoked pursuant to 28 U.S.C. § 1915(a)(3). Plaintiff's application for CM/ECF Registration (# 3 ) is DENIED. This action should be DISMISSED, without service of pro cess, for lack of subject matter jurisdiction and failure to state a claim upon which relief may be granted. A judgment should be entered dismissing the action without prejudice. This Findings and Recommendation will be referred to a district judge . Objections, if any, are due December 5, 2016. If no objections are filed, then the Findings and Recommendation will go under advisement on that date. If objections are filed, then a response is due within 14 days after being served with a copy of the objections.
