Evidence of defendant Berge's conviction for first-degree official misconduct, ORS 162.415(1), and of the reasons for his resignation from Portland Police Bureau is not admissible to attack his character for truthfulness under Rule 609(a)(2). The City's Motion for Summary Judgment 48 is GRANTED with respect to plaintiffs' Fourth Amendment and racial discrimination claims and DENIED with respect to plaintiffs' state law claims.
