Filing 50 Opinion and Order - The Court ADOPTS IN PART and DECLINES TO ADOPT IN PART the F&R (ECF 27 ). Regarding Claim One, the Court GRANTS Multnomah County Health Department's Motion to Dismiss (ECF 6 ) and GRANTS IN PART the State Defendants' M otion to Dismiss (ECF 7 ). Regarding Claim Two, the Court DENIES IN PART the State Defendants' Motion to Dismiss (ECF 7 ). The Court dismisses without prejudice Bullseye's first claim to the extent that Bullseye alleges a violation of 42 U.S.C. § 1983. The Court, however, dismisses with prejudice Bullseye's first claim to the extent that Bullseye alleges a violation of 42 U.S.C. § 1985. The Court does not dismiss Bullseye's second claim.
