OPINION AND ORDER. For the reasons stated, the Court DENIES Miller's motion for reconsideration and certification to the Oregon Supreme Court (ECF No. 175 ) and DENIES Miller's motion to modify scheduling order and for leave to file a second amended complaint (ECF No. 179 ). As discussed above, if either party objects to the Court's dismissal of this action without prejudice to be refiled in state court, the party may file a written response by June 2, 2023, addressing why the Court should continue to exercise its supplemental jurisdiction.
