August 30, 2018 Opinion or Order Filing 76 OPINION AND ORDER: The County's motion for summary judgment (ECF # 29 ) with respect to Counts One and Four is granted, and defendants' motion for summary judgment (ECF # 42 ) on those claims is denied. The County's motion for preliminary injunction (ECF # 29 ) is denied as moot. The motions for summary judgment (ECF ## 29 , 42 ) regarding Counts Two and Three are also denied as moot. The 2018 Tier 1 FOA is vacated. The parties shall confer and submit to the court by September 14, 2018, a proposed order suspending the lapse provision and extending the term of budget authority.
