Filing 7 FINDINGS AND RECOMMENDATION: For the reasons stated, the Court recommends that the district judge dismiss Morgan's complaint, and allow him to file an amended complaint within thirty days. If Morgan fails to file an amended complaint curing the noted deficiencies within thirty days, the district judge should dismiss this case with prejudice. Further, the Court DENIES Plaintiff's motion for appointment of counsel (ECF No. #3 ), because Plaintiff is unlikely to succeed on the merits of his claims, and therefore exceptional circumstances do not exist to warrant appointment of pro bono counsel at this time.
