April 3, 2019 Filing 7 FINDINGS AND RECOMMENDATION: For the reasons stated, the Court recommends that the district judge dismiss Morgan's complaint, and allow him to file an amended complaint within thirty days. If Morgan fails to file an amended complaint curing the noted deficiencies within thirty days, the district judge should dismiss this case with prejudice. April 3, 2019 Opinion or Order Filing 6 ORDER: Plaintiff moves to proceed in forma pauperis (ECF No. #2 ). An examination of the application reveals that Plaintiff is unable to afford the costs of this action. Accordingly, the Court GRANTS Plaintiff's application. This action may go forward without payment of fees or costs. However, the Clerk of the Court shall not issue process until further order of the Court. Further, the Court DENIES Plaintiff's motion for appointment of counsel (ECF No. #3 ), because Plaintiff is unlikely to succeed on the merits of his claims, and therefore exceptional circumstances do not exist to warrant appointment of pro bono counsel at this time.
