April 24, 2020 Filing 11 FINDINGS AND RECOMMENDATION: Blocker's complaint (ECF No. #1 ) should be dismissed sua sponte for failure to state a claim with leave to file an amended complaint curing the identified deficiencies within thirty days of the district judge's order of dismissal. The court recommends the district judge advise Blocker that failure to file an amended complaint which cures the deficiencies shall result in a dismissal of this proceeding, with prejudice. SCHEDULING ORDER: The Findings and Recommendation will be referred to a district judge for review. Objections, if any, are due within seventeen (17) days. If no objections are filed, then the Findings and Recommendation will go under advisement on that date. If objections are filed, then a response is due within fourteen (14) days after being served with a copy of the objections. April 3, 2020 Opinion or Order Filing 6 ORDER : Plaintiff brings this civil action prose. Pursuant to 28 U.S.C. 1914, a party seeking to institute a civil action shall pay a filing fee of $350.00 plus an administrative fee of $50.00. An action may proceed without the prepayment of a filing fee only upon a proper application to proceed in forma pauperis. See 28 U.S.C. 1915 (2019). Plaintiff did not pay the filing fee or submit an application to proceed in forma pauperis. Accordingly, IT IS ORDERED that plaintiff shall submit a filing fee or an application to proceed in forma pauperis within thirty (30) days of the date of this Order. Plaintiff's failure to do so will result in the dismissal of this action. The Clerk of the Court is directed to send plaintiff a form application to proceed in forma pauperis with this order.
