December 18, 2020 Filing 59 MINUTES of Proceedings: In light of Defendant The Contingent's Motion for Leave to Deposit Funds, ECF #58 , and the understanding that the amount covers the remaining funds in the Oregon Cares Fund, the parties agree that Plaintiffs' Renewed Motion for TRO or Preliminary Injunction, ECF #39 , is moot. Accordingly, Plaintiffs' Renewed Motion, ECF #39 , is DENIED as moot. In an accompanying order, this Court orders the Clerk of Court to accept funds payable to the Clerk, U.S. District Court, in the amount of $8,814,120, and to deposit these monies into the Court Registry Investment System (CRIS). ECF #60 . According to the parties' agreement at the hearing held on December 17, 2020, cross-briefs on the limited issue of whether those who failed to submit grant applications before the Fund closed have any claim for relief are due by December 29, 2020. Optional replies to cross-briefs of no more than five pages are due by December 31, 2020. A hearing on this limited issue will be held on January 5, 2021, at 3:00 p.m. in Portland by videoconference before Judge Karin J. Immergut. The Court also orders the parties to attend mediation within 60 days. At the hearing on January 5, 2021, the Court will set an expedited briefing and hearing schedule regarding both class certification and the merits of Plaintiffs' claims. Bradley A. This Court held a scheduling conference on Plaintiff's Motion for Temporary Restraining Order #12 on November 9, 2020 at which counsel for Defendants offered to post a $200,000 bond with this Court, which Defendants contend exceeds the maximum grant amount under the challenged program, to reserve for Plaintiff if Plaintiff succeeds on the merits of its Complaint. The irreparable injury and need for urgency asserted by Plaintiff in its briefing is that "the program is required to expend all funds before the end of the year." This Court hereby orders briefing on the limited issue of whether Plaintiff can establish irreparable harm to support a preliminary injunction in light of Defendants' offer to post the bond.
