March 29, 2021 Opinion or Order Filing 10 ORDER - Plaintiff filed this case on March 12, 2021, representing himself. The Court granted Plaintiff's motion to proceed in forma pauperis and gave him 30 days to complete a summons and U.S. Marshals Service Form, and provide copies of the Complaint and the Court's Social Security Procedural Order previously mailed to Plaintiff. The Court provided Plaintiff with copies of these forms. These forms are not complicated to complete. The Court allowed Plaintiff an additional 30 days to complete the forms, extending Plaintiff's deadline to return the service documents to May 14, 2021. The Court also extended the deadline by which Plaintiff, through the U.S. Marshals, must serve Defendant. Plaintiff now requests an extension of 120 days, so that he may try to find an attorney or become more familiar with his case and the requirements of litigation. The Court does not believe any further extension is necessary at this time for Plaintiff to complete and return the service documents. The Court may provide Plaintiff additional time to complete his brief on the merits of his claim, but that is not what is currently pending. The only thing currently pending is for Plaintiff to complete and return the service documents. Accordingly, Plaintiff's motion for extension of time (ECF #9 ) is DENIED without prejudice to renew when Plaintiff's brief on the merits becomes pending. Ordered by Judge Michael H. Simon. March 22, 2021 Opinion or Order Filing 8 ORDER - Plaintiff, representing himself, filed a complaint for review of the Commissioner's decision denying social security benefits. The Court granted Plaintiff's application to proceed in forma pauperis. This means, among other things, that the U.S. Marshals will serve Defendant with the summons and complaint to start the lawsuit (service of process). Plaintiff has filed a motion for extension of time to file documents (ECF 6), in which he references the general case schedule for Defendant to file his Answer and the parties to file their respective briefs. At this time, however, Plaintiff's only deadline is the one set in the Court's order granting Plaintiff's motion to proceed in forma pauperis (ECF 4), relating to service of process. By April 14, 2021, Plaintiff must complete an original Summons and U.S. Marshals Service Form (USM285), and provide the originals plus copies to the Clerk of the Court, along with copies of the Complaint and the Social Security Case Procedural Order (ECF 2, 4), for the Marshals to serve on Defendant. Defendant will then have 120 days to file his Answer. Only after Defendant files his Answer will Plaintiff face his next deadline. The Court construes Plaintiff's motion as a request for an extension of time to complete and return the service documents. This motion is GRANTED. The Court extends the deadline by 30 days, until May 14, 2021. Plaintiff may, however, return the service documents (Summons, U.S. Marshals Service Form, Complaint, and Social Security Procedural Order) sooner than May 14, 2021, if Plaintiff chooses. The Court also extends under Rule 4(m) of the Federal Rules of Civil Procedure by 30 days the deadline by which Plaintiff (through the U.S. Marshals) must serve Defendant. The Clerk of the Court is directed to send Plaintiff a summons and a USM285 form along with this Order. Ordered by Judge Michael H. Simon. (Deposited in outgoing mail to pro se party on 3/22/2021.)
