ORDER: The Court DENIES Plaintiff's Motion for Reconsideration #10 of the Order denying Plaintiff's Motion for Appointment of Counsel as Plaintiff has not established exceptional circumstances at this juncture. Plaintiff has also filed a "Motion for Default" #13 in which he seeks an "order of default to order issued 10-29-21" and asks the Court for an "order of default dismissing defendants' motion to dismiss for failure to state a claim." The motion is in substance a motion to strike Defendants' response to Plaintiff's Objection to Removal because it was not filed by 11/15/202, as ordered by the Court on 10/29/2021. The motion is DENIED. Although Defendants proffer no explanation for the late filing, it was filed only four days late and Plaintiff has suffered no prejudice. As previously ordered, Plaintiff's reply is due 14 days after he received a copy of Defendants' response. Ordered by Magistrate Judge Youlee Yim You. ORDER: Defendants have until 11/15/2021, to file a response to Plaintiff's "Motion to Object" #8 , which the Court construes as a request to remand this action to state court. Plaintiff shall file a reply, if any, within 14 days after receiving a copy of defendants' response. Defendants' Motion to Dismiss for Failure to State a Claim #5 is HELD IN ABEYANCE pending resolution of Plaintiff's request to remand. The Court DENIES Plaintiff's Motions for Appointment of Counsel #6 and #7 as Plaintiff has not established exceptional circumstances warranting the appointment of pro bono counsel at this juncture.
