Filing 8 (WITHDRAWN SEE ECF #10) ORDER - Defendant filed a motion to dismiss on April 18, 2022. ECF #5 . Plaintiff's response was due on May 2, 2022. Instead of filing a response, Plaintiff filed an amended complaint. ECF #7 . Plaintiff, however, has not moved to amend, Defendant does not appear to have consented to Plaintiff's amendment, and the time to file an amended pleading as a matter of right has passed. See Fed. R. Civ. P. 15 . Thus, Plaintiff shall file within one week from the date of this Order an explanation of why filing an amended complaint without indicating that Defendant does not oppose that amendment, in lieu of filing a response to the motion to dismiss and requesting leave to amend, is appropriate, especially given that the Court has already addressed this issue with Plaintiff's counsel in another case.
