ORDER: The Court DENIES Plaintiff's Motion for Reconsideration #7 of the Order Denying Application to Proceed In Form Pauperis. The two District Court dismissals described in the Court's Order, which were based on Heck v. Humphrey, 512 U.S. 477 (1994) clearly count as strikes under 28 U.S.C. Sec. 1915(g), and this Court lacks the authority to re-characterize as "affirmances" the Ninth Circuit Court of Appeals' decisions dismissing the appeals therefrom as frivolous. See Washington v. L.A. Cnty. Sheriffs Dept, 833 F.3d 1048, 1054 (9th Cir. 2016), El-Shaddai v. Zamora, 833 F.3d 1036, 1045-46 (9th Cir. 2016). Plaintiff has until 11/21/2022, to pay the $402.00 filing fee, and is advised that if he fails to do so this action will be dismissed without prejudice. Ordered by Judge Michael W.
