October 25, 2022 Opinion or Order Filing 6 ORDER: The Court DENIES Plaintiff's Amended Application to Proceed In Forma Pauperis #5 . A review of the application indicates that Plaintiff has regular income of approximately $39,984 per year (based on his report of $3,332 per month in Veterans Administration disability benefits. Currently, a single person is below the federal poverty guidelines if the person's annual income is below $13,590. Because Plaintiff's income is above that guideline, he has not shown that he is unable to pay the filing fee. 28 U.S.C. Sec. 1915(a)(1); see Lopez-Ruiz v. Tripler Army Med. Ctr.s Postdoctoral Fellowship in Clinical Psych., No. CV. 11-0066 JMS/BMK, 2011 WL 486952, at *1 (D. Haw. Feb. 4, 2011). Plaintiff is ordered to pay the filing fee within ten (10) days of the date of this Order. Failure to do so will result in dismissal of the action without prejudice #5 . Ordered by Judge Marco A. October 6, 2022 Opinion or Order Filing 4 ORDER: Plaintiff John D. moves to proceed in forma pauperis (IFP) in this action. ECF 2. However, Plaintiff's application is incomplete in the following respect: In his answer to question four, Plaintiff indicated that he receives $3,332 in Disability or worker's compensation. Plaintiff, however, has not provided any additional detail as to the frequency with which he receives this benefit (for example, monthly or yearly) and whether he expects to continue to receive additional funds in the future. Accordingly, the Court orders Plaintiff to supplement his IFP application with this additional information by filing an amended application or declaration within 14 days of this Order.
