Filing 7 ORDER referring Findings & Recommendation: #6 to Judge Adrienne Nelson. Ordered by Magistrate Judge Jeffrey Armistead.(Deposited in outgoing mail to pro se party on 4/5/2023.) (pjg) |
Filing 6 FINDINGS AND RECOMMENDATION: Miller previously was provided an opportunity to correct the deficiencies in her complaint. In its Order to Amend, the court explained that Miller's complaint failed to state plausible claims for negligence or discrimination against any defendant and failed to establish this basis for this court's jurisdiction. Miller has not addressed those issues or offered any allegations that suggest her claims could be saved if granted leave to amend. Thus, the court concludes that additional factual details are not forthcoming and that leave to amend would be futile. Accordingly, the court recommends that Miller's amended complaint (ECF No. #4 ) be DISMISSED without leave to amend. SCHEDULING ORDER The Findings & Recommendation will be referred to a District Judge. Objections, if any, are due within 14 days. If no objections are filed, the Findings & Recommendation will go under advisement on that date. If objections are filed, a response is due within 14 days. When the response is due or filed, whichever date is earlier, the Findings & Recommendation will go under advisement. DATED: April 5, 2023, by United States Magistrate Judge Jeff Armistead.(Deposited in outgoing mail to pro se party on 4/5/2023.) (pjg) |
Filing 5 Amended Complaint pursuant to the order to amend #4 filed by Plaintiff. Filed by Joy Miller against All Defendants. (kgc) |
Filing 4 ORDER TO AMEND: To avoid dismissal of her action, Miller must file an AMENDED COMPLAINT curing the deficiencies identified above within 30 days of the date of this ORDER. If Miller fails to do that, the court may dismiss this action. The court GRANTS Miller's application to proceed in forma pauperis (ECF No. #2 .). DATED: February 21, 2023, by United States Magistrate Judge Jeffrey Armistead. (Deposited in outgoing mail to pro se party on 2/21/2023.) (pjg) |
