ORDER OF DISMISSAL: On 9/11/2023, Plaintiff was ordered to file an amended complaint by 10/11/2023 that complies with the requirements of the Federal Rules of Civil Procedure and cures the deficiencies as stated in this Court's Order #5 . Plaintiff was further advised that failure to file an amended complaint as ordered would result in the dismissal of this action with prejudice. Plaintiff has failed to timely file an amended complaint. IT IS THEREFORE ORDERED that this action is DISMISSED with prejudice. Pending motions, if any, are DENIED AS MOOT. (of Tempe, Arizona) be "admitt[ed] as [his] legal representation." Pl.'s Mot. 1 (doc. #6 ). However, Gen Digital, Inc. has neither filed a Notice of Appearance nor followed the procedures specified in the Court's Local Rules for the admission of out-of-state counsel. Further, there are no claims currently pending, such that service of process has not yet occurred, in light of the Court's 9/11/2023 Order #5 dismissing plaintiff's complaint without prejudice.
