ORDER issued by Magistrate Judge Jolie A. Russo: Plaintiff's Motion for Extension of Time #13 is Granted. Plaintiff shall have until 3/15/2024 to amend the complaint and complete service of summons. Plaintiff's Motion for Appointment of Counsel #14 is Denied but with leave to renew. There is generally no right to counsel in a civil case; yet the court may, under "exceptional circumstances," request pro bono counsel pursuant to 28 U.S.C. 1915(e)(1). Palmer v. Valdez, 560 F.3d 965, 970 (9th Cir. 2009) (citations omitted). In determining whether "exceptional circumstances" exist, a court considers the plaintiff's likelihood of success on the merits and ability to articulate claims pro se in light of the complexity of the legal issues involved. Id. (citations omitted). Here, plaintiff has filed a detailed complaint alleging two claims for relief. And plaintiff has recently litigated at least one other case in this District pro se. Accordingly, there is no indication plaintiff cannot articulate the relief he seeks and the requisite exceptional circumstances are absent. (Deposited in outgoing mail to pro se party on 1/19/24.)
