Order: The court construes plaintiff's Motion to Strike the Motion to Dismiss #11 as a his response to the pending Motion to Dismiss #9 . Defendant's optional reply is due 3/15/24. The court will take defendant's Motion to Dismiss under advisement on 3/15/24. Any requests for oral argument will be considered in due course. Aside from defendant's optional reply, no further filings from either party will be accepted by the court without prior approval until a district court judge has issued a final ruling on the pending Motion to Dismiss #9 . ORDER TO AMEND: To avoid dismissal of his action, Saunders must file an AMENDED COMPLAINT with sufficient factual allegations to support personal jurisdiction, venue, and that this action is unrelated to the Virginia divorce decree within 30 days of the date of this ORDER. That is, Saunders has until February 8, 2024, to file an AMENDED COMPLAINT. If Saunders fails to do that, the court may dismiss this action.
