ORDER REMANDING THE CASE TO STATE COURT: This Court has reviewed Defendants' Application for Leave to Proceed IFP, ECF #1 , and Notice of Removal, ECF #2 , and REMANDS this case to the Multnomah County Circuit Court for the State of Oregon (Case No. 24LT07027). In Defendants' Notice of Removal, they assert several counterclaims as the basis for federal question jurisdiction. ECF #2 at 1. But a counterclaim cannot create federal question jurisdiction. Holmes Grp., Inc. v. Vornado Air Circulation Sys., Inc., 535 U.S. 826, 830-31 (2002). And Defendants cannot rely on diversity jurisdiction, given that all parties here are domiciled in Oregon. ECF #2 at 2. Accordingly, this case must be remanded. Ordered on 4/23/2024 by Judge Karin J. Immergut. (jy)
