MINUTE ORDER granting #9 Motion to Intervene as Defendants: Before the Court is the motion of Northwest Environmental Defense Center, Center for Biological Diversity, Willamette Riverkeeper, and The Conservation Angler ("Conservation Groups" or "Defendant-Intervenors") to intervene as Defendants. The Court finds that at least one of the Conservation Groups has standing to sue based on the declarations provided in their motion. The Court also finds that the Conservation Groups have a legally cognizable interest in implementation of the challenged agency actions; that prohibiting intervention would risk impairing their ability to protect that interest; and that Defendants here may not adequately represent those interests given the history of litigation between Defendants and the Conservation Groups over these agency actions. Accordingly, the Court GRANTS the Conservation Groups' motion for intervention as of right. In their reply in support of their motion to intervene, Defendant-Intervenors represent that they intend to file a motion to transfer this litigation to the District of Oregon. ECF #20 at 17. The Court hereby ORDERS that the Parties shall file, by February 14, 2025, a proposed briefing schedule for Defendant-Intervenors' anticipated motion to transfer. Signed by Judge Jia M.
