Filing 20
MINUTES of Proceedings: Oral Argument held before Judge Michael J. McShane regarding Defendants' Motion to Dismiss First Claim #6 on April 3, 2026. The Court denies the motion. Written opinion to follow. Status Conference held. One of the Janci cases will begin trial November 2, 2026, with location to be determined. The Pretrial Conference for that case will be set for 9:00 a.m. on October 19, 2026, in Portland before Judge Michael J. McShane. Second trial will begin January 4, 2027 with one of the Merithew cases. Location to be determined. Third case will be one of the Kafoury cases. Location to be determined. Parties to provide status report indicating if the parties in any case consent to magistrate judge jurisdiction. Other judges will likely hear some or perhaps all of the cases following the November 2026 trial. Court extends deadlines: For cases filed before December 2025, fact discovery ends June 15, 2026, Expert disclosures are due July 15, 2026, dispositive motions are due August 6, 2026 with responses due August 27, 2026, and replies due September 10, 2026. Parties to confer on discovery deadlines for cases filed December 2025 and later and provide proposed deadlines to the Court. Parties will generally have to rely on depositions taking place in the coming weeks. If a party feels a second deposition is needed, they will need to demonstrate cause and identify targeted issues. But generally Plaintiffs' counsel in all the cases should work together to ensure the upcoming depositions capture all the necessary information. ORDER: Redacted complaints are to be provided unredacted under attorney's eyes only designation. If there are third party reporters, the parties will have to come to the Court for a process to give those third parties the opportunity to speak with attorneys or not. For expunged records, the Court understands that there may not be records. But the Court agrees with the Plaintiffs on this issue and the expungement statute is to protect the youths, not keep the youth from accessing records. If there are records, the state needs to turn them over to the youth. Jesse A. Merrithew and Hong (Chen-Chen) Jiang present as counsel for plaintiffs. Nathaniel Aggrey and Jessica Kampfe present as counsel for defendants. Court Reporter: Jill Jessup. Judge Michael J. McShane presiding. (gw)
