ORDER: Plaintiffs have filed a Motion to Clarify the Record Regarding Party Designations #27 in which they refer to "recent court proceedings" where "Plaintiff Forrest Duane Sower was inadvertently referred to by the Court as 'The Defendant.' "Plaintiffs request that "[t]o ensure an accurate, unambiguous, and clear record moving forward-and to prevent any potential confusion during future pretrial hearings or at the eventual trial of this matter-Plaintiffs request that the record explicitly reflect that Forrest D. Sower is a Plaintiff in this action, not a Defendant." Plaintiffs apparently refer to Judge Simon's order issued on June 2, 2026, which states: "Plaintiffs also attached a printout... regarding Defendant Forrest D. Sower's veteran's benefits[.]" This is obviously a scrivener's error. There is no question that Forrest D. Sower is a plaintiff in this case, and a scrivener's error in a court order does not convert his status as a plaintiff to that of a defendant.
