ORDER TO AMEND: the court ORDERS that Tafoya must file an amended complaint within 30 days curing the deficiencies noted above if he wishes to proceed with this case. Tafoya is advised that if he does not file an amended complaint within the time provided, this action will be dismissed as required under 28 U.S.C. 1915(e)(2) and 1915A(b). The dismissal will be without prejudice to Tafoyas right to pursue any appropriate claims in state court. Tafoya has not established exceptional circumstances at this juncture of the proceedings and, therefore, the court DENIES Tafoyas motion for appointment of counsel (ECF No. #3 )). See Agyeman v. Corrections Corporation of America, 390 F.3d 1101, 1103 (9th Cir. 2004). This does not preclude the court from determining at a later date, if circumstances warrant, to exercise its discretion to seek representation from a member of the districts pro bono attorney panel. IT IS ORDERED that the Oregon Department of Corrections, Central Trust Unit must collect payments from Tafoyas prison trust account and forward those payments to the Clerk of the Court in accordance with the formula set forth above until a total of $350.00 has been collected and forwarded to the Clerk of the Court. The payments must be clearly identified by the name and number assigned to this action. The Clerk of the Court is directed to send an electronic copy of this order to: [email protected].
