ORDER TO AMEND: IT IS ORDERED that Plaintiff must file an Amended Complaint curing the deficiencies noted above within 30 days of the date of this Order. Plaintiff is advised that failure to do so will result in the dismissal of this action. Because Plaintiff has not established exceptional circumstances at this juncture, the Court DENIES Plaintiffs Motion for Appointment of Counsel (ECF No. #3 ). See Agyeman v. Corr. Corp. of Am., 390 F.3d 1101, 1103 (9th Cir. 2004) (determining whether exceptional circumstances exist turns on an evaluation of the likelihood of a plaintiff's success on the merits and the plaintiff's ability to articulate her claims in light of the complexity of the legal issues involved).
